Terms of Service
These Terms of Service apply to all purchases made on www.kapkaenamelware.com (the "Website"). The Website is operated by KAPKA Hediyelik Eşya A.Ş., Çalıkuşu Sokak No: 5/A-B, Hasanpaşa Mahallesi, 34722 Kadıköy, İstanbul, Türkiye ("KAPKA", "we", "us"). By placing an order you agree to these terms. Please read them together with our Shipping Policy, Refund Policy and Privacy Policy.
1. Products
Our enamelware is handmade in Istanbul. Each piece is shaped, enamelled and fired by hand, so small variations in colour, pattern and finish are part of its character and are not defects. Product photos are as accurate as possible, but colours may look slightly different depending on your screen. Care instructions are provided on our product pages and in our Craft & Care guide.
2. Prices and payment
Prices are shown in euros (EUR). As described in our Shipping Policy, prices do not include import duties, customs fees or local taxes charged by the destination country. Shipping costs are calculated and shown at checkout. Payment is taken when your order is placed, using the payment methods offered at checkout.
3. Orders
After you place an order you will receive an order confirmation by e-mail. A contract is formed when we confirm that your order has been shipped. We may refuse or cancel an order, for example if a product is out of stock, if there is an obvious pricing error, or if we cannot deliver to your address. In that case any payment you have made will be refunded in full.
4. Delivery
Delivery is carried out as described in our Shipping Policy. Risk of loss passes to you when the products are delivered to the address you provided.
5. Right of withdrawal, returns and faulty products
You may cancel your purchase within 14 days of receiving the goods without giving a reason. Returns, refunds and the handling of faulty or non-conforming products are described in our Refund Policy.
6. Wholesale and custom orders
Wholesale, corporate and custom orders are agreed separately in writing with KAPKA and may be subject to different terms.
7. Intellectual property
All designs, patterns, photographs, texts and the KAPKA name and logo on this Website belong to KAPKA or its licensors. They may not be copied or used commercially without our written permission.
8. Liability
Nothing in these terms limits any rights you have as a consumer under the mandatory laws of your country of residence. To the extent permitted by law, KAPKA is not liable for indirect or consequential losses, or for delays caused by events outside our reasonable control.
9. Governing law
These terms are governed by the laws of the Republic of Türkiye. If you are a consumer living in another country, you also keep the protection of the mandatory consumer laws of your country of residence.
10. Changes
We may update these terms from time to time. The version published on the Website at the time of your order applies to that order.
